We are currently appealing the summation of the case. It does not reflect what Judge Fearon stated.
Ms Fogg was paid as normal for the two weeks after she left our premises. We then liaised with ACAS and paid the sum agreed with them 6 days later. The payments were made 6 months before the case was heard.
The judge found that we had overpaid Ms Fogg by one day's holiday pay.
We dropped the counterclaim as we were told we'd won all the arguments and it seemed churlish to seek a payment from Ms Fogg.
